Welcome to Agreeish.
These Terms of Use ("Terms") govern your access to and use of the Agreeish website, services, features, and related applications (collectively, the "Service").
By accessing or using Agreeish, you agree to these Terms. If you do not agree, do not use the Service.
1. About Agreeish
Agreeish is an entertainment platform where people can answer opinion questions, compare their answers with other participants, and view aggregated results, including comparisons between countries.
Agreeish is not a scientific polling service, research panel, representative public-opinion survey, or professional advisory service.
Results reflect only responses submitted through Agreeish and should not be interpreted as representative of any country, population, demographic group, or the public generally.
2. Age Requirement
You must be at least 18 years old to use Agreeish.
By accessing or using the Service, you confirm that you are 18 or older and legally able to agree to these Terms.
If we reasonably believe that an account or user belongs to someone under 18, we may restrict or terminate access and, where appropriate, delete associated account data.
To report a potentially underage user, contact support@agreeish.com.
3. Using Agreeish Without an Account
You may use core voting features without creating an account.
Agreeish may use a pseudonymous browser/device identifier, a session identifier, country-level information, and limited technical or operational information to:
- remember votes and progress
- prevent duplicate, automated, fraudulent, or abusive voting
- maintain the voting experience
- calculate aggregated results
- operate, secure, troubleshoot, and measure the Service
- protect the Service from abuse and technical failure
Optional product analytics and first-party operational telemetry are described separately in the Privacy Notice. Turning off optional analytics does not necessarily disable information needed to provide requested features, maintain security and vote integrity, or operate and troubleshoot the Service where permitted by applicable law.
4. Accounts
Creating an account is optional unless a particular feature states otherwise.
An account may allow you to preserve features such as:
- voting history
- XP and levels
- streaks
- nickname or profile information
- progress across devices
You are responsible for maintaining the security of your account, email account, device, and credentials and for activity performed through your account unless applicable law provides otherwise.
You must not:
- impersonate another person
- access another user's account without permission
- create accounts for abusive, deceptive, or fraudulent purposes
- attempt to bypass account, authentication, or security restrictions
- share or expose authentication links, access tokens, or other credentials
You may log out or submit an account-deletion request through Settings or by contacting support. Deletion requests are handled after verification; submitting a request does not necessarily result in immediate deletion from every active system or backup.
5. Nicknames and Profile Features
Agreeish may assign a curated or generated nickname to an account. Nicknames do not establish ownership of a name, trademark, identity, or unique public handle unless we expressly state otherwise.
We may replace, restrict, or remove a nickname when needed to fix an error, prevent impersonation or abuse, protect rights, or protect the Service.
6. Voting and Results
You may submit votes only through the normal Agreeish experience and in accordance with these Terms.
You must not:
- automate votes
- use bots or scripts to submit votes
- intentionally submit duplicate votes
- manipulate or attempt to manipulate poll results
- bypass voting restrictions or rate limits
- falsify technical, country, visitor, session, or account identifiers
- interfere with country, sample, or aggregation calculations
- coordinate abusive activity intended to distort results
Agreeish may disregard, remove, reclassify, aggregate differently, or exclude activity that we reasonably believe is fraudulent, automated, duplicated, abusive, technically invalid, or otherwise inconsistent with the integrity of the Service.
Counts and percentages may change as additional votes arrive, invalid activity is removed, bugs are corrected, thresholds are applied, or aggregation logic is updated.
7. Permission to Process Submitted Responses
You retain any rights you may have in information you submit. By submitting a vote or other permitted response, you authorize Agreeish to process, store, reproduce, analyze, aggregate, calculate, display, transmit, de-identify, and otherwise use that response as reasonably necessary to operate, secure, maintain, improve, and provide the Service and aggregated results, subject to the Privacy Notice and applicable law.
This permission is worldwide, non-exclusive, and royalty-free because Agreeish must be able to process a response wherever its infrastructure and service providers operate. It does not give Agreeish ownership of your personal information or override privacy rights that cannot legally be waived.
If an account is deleted, de-identified or reassigned vote records may remain where needed to preserve aggregate poll integrity, as described in the Privacy Notice.
8. Country Comparisons
Country comparisons are based on Agreeish responses associated with the relevant country and are provided for entertainment and comparison purposes only.
A displayed country percentage does not mean that the result reflects the views of that country's population. Agreeish may require a minimum number of responses before displaying country-level results and may change those thresholds or calculation rules.
9. XP, Levels, Streaks, and Progress
Agreeish may provide progress features including XP, levels, streaks, voting history, milestones, or similar mechanics.
- they have no monetary value
- they cannot be exchanged for cash
- they do not represent property, currency, stored value, or a financial instrument
- they may depend on continued availability of the Service
- their rules, thresholds, values, and presentation may change
We may correct, reduce, restore, or reset progress data when reasonably necessary to address technical errors, duplicate activity, fraud, abuse, testing, migrations, or data-integrity issues.
10. Sharing and Links
Agreeish may allow you to share links to questions, results, recaps, or other parts of the Service. Shared experiences may change over time and may require a recipient to vote or take another action before certain results are displayed.
You may not use sharing features to:
- send spam
- distribute malicious, deceptive, or unauthorized links
- misrepresent Agreeish or another person
- harass other people
- unlawfully distribute content or personal information
Do not place passwords, authentication credentials, financial account information, or other highly sensitive information in URLs or query parameters.
11. Acceptable Use
You must not:
- interfere with, overload, or disrupt Agreeish
- probe, attack, or attempt to compromise the Service without authorization
- attempt to bypass authentication, authorization, rate limits, anti-abuse systems, or security controls
- access administrative or non-public features without authorization
- scrape, crawl, or systematically extract data except as permitted by law or with our permission
- reverse engineer the Service except where applicable law expressly permits it
- introduce malware, harmful code, or abusive automated traffic
- use the Service for unlawful, deceptive, or fraudulent activity
- impersonate Agreeish, its operator, or another person
- use the Service in a manner that materially harms other users, data, infrastructure, or the Service
Good-faith security research should not be conducted against production systems without prior authorization.
12. Intellectual Property
The Agreeish name, branding, interface, design, software, original content, graphics, and other materials provided through the Service are owned by or licensed to Agreeish or its operator and are protected by applicable intellectual-property laws.
Subject to these Terms, you may use the Service for personal, non-commercial use. Nothing in these Terms grants you ownership of Agreeish intellectual property or a right to reuse the Service's content, branding, data, or software beyond what the Service itself permits or applicable law requires.
13. Third-Party Services
Agreeish relies on third-party providers for hosting, database and authentication services, analytics, email delivery, network and security functions, and other technical operations.
Your use of third-party authentication or external services may also be subject to the relevant provider's own terms and privacy policies. Agreeish is not responsible for a third party's independent service, content, availability, or privacy practices to the extent permitted by law.
14. Availability and Changes to the Service
We may:
- add, remove, test, or modify features
- modify questions or categories
- change the presentation or calculation of results
- update progress mechanics
- change technical, anti-abuse, or eligibility rules
- perform maintenance
- suspend parts of the Service
- discontinue features or the Service
We aim to keep Agreeish available and reliable, but we do not guarantee uninterrupted, secure, or error-free access, preservation of every feature, or compatibility with every browser, device, or third-party service.
15. Suspension and Termination
We may suspend, restrict, or terminate access to Agreeish if we reasonably believe that you violated these Terms, manipulated voting or analytics, attempted unauthorized access, abused another user or the Service, created material security or legal risk, or used the Service unlawfully.
Where practical, we may provide notice, but we may act immediately when necessary to protect users, data, infrastructure, service integrity, or legal rights.
You may stop using Agreeish at any time.
If you have an account, you may submit a deletion request through Settings or support@agreeish.com. Account-linked information is deleted, reassigned, or de-identified as described in the Privacy Notice; de-identified or reassigned vote totals may remain to preserve aggregate results and integrity.
16. Disclaimer
Agreeish is provided primarily for entertainment.
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy, to the extent those warranties may lawfully be disclaimed.
We do not guarantee that:
- results are statistically representative, complete, or suitable for research
- every response is accurate or genuine
- the Service will always be available, secure, or uninterrupted
- every error, vulnerability, or data inconsistency will be corrected immediately
- any particular feature, result, account state, progress mechanic, or dataset will remain available permanently
Agreeish results should not be relied upon as professional, legal, medical, financial, political, scientific, safety, or other expert advice.
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Agreeish and its operator, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, opportunities, or business arising from or related to your use of, or inability to use, the Service.
To the maximum extent permitted by applicable law, the total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid directly to Agreeish for the Service during the 12 months before the event giving rise to the claim or (b) US$100.
The exclusions and cap above do not apply to liability that cannot legally be excluded or limited, and they do not reduce any mandatory consumer remedy available to you under applicable law.
18. Third-Party Claims Caused by Misuse
To the extent permitted by applicable law, if your unlawful use of the Service, intentional violation of these Terms, infringement of a third party's rights, or unauthorized manipulation of the Service causes a third-party claim against Agreeish, you are responsible for the losses and reasonable costs directly resulting from that conduct. This section does not apply to the extent a claim was caused by Agreeish or where applicable consumer law does not permit such an obligation.
19. Privacy
Our collection and use of information is described in the Agreeish Privacy Notice. Please review it to understand how guest identity, accounts, votes, operational telemetry, optional analytics, deletion, and service providers are handled when you use the Service.
20. Applicable Law and Mandatory Rights
These Terms are interpreted subject to applicable law. Nothing in these Terms is intended to deprive you of a consumer, privacy, or other statutory right that cannot legally be waived or limited by contract.
Any dispute must be brought in a court or forum that has lawful jurisdiction under the rules applicable to the parties and the dispute. Agreeish does not waive any right it may have to object to an improper or inconvenient forum.
21. Changes to These Terms
We may update these Terms as Agreeish develops or when legal, technical, security, product, or operational requirements change.
When we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate or required.
Your continued use of Agreeish after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law. If a law requires a different form of consent or notice for a particular change, that law controls.
22. Miscellaneous
These Terms, together with the Privacy Notice and any additional terms expressly presented for a specific feature, form the agreement governing your use of the Service.
If any provision is found unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not transfer your rights or obligations under these Terms in a way that would circumvent account or security restrictions. Agreeish may transfer these Terms as part of a reorganization, financing, acquisition, sale of assets, or transfer of the Service, subject to applicable law and the Privacy Notice.
Section headings are for convenience only and do not limit the meaning of the Terms.
